Defendant seeks his release from the Department of Mental Health, Center for Forensic Psychiatry, where he is confined under the Criminal Sexual Psychopath Act ("CSPA"), MCL 780.501 et seq.; MSA 28.967(1) et seq. (repealed 1967 and 1968), as applied to him pursuant to Administrative Order 1969-4, 382 Mich xxix, which continued in effect the CSPAs release provisions for those confined under that statute. Defendant comes before this Court on remand from the Supreme Court as on leave granted, following the circuit courts denial of his petition for discharge brought pursuant to section 7 of the CSPA.
